Bloomington woman arrested on theft charge after rent check for Solsberry residence bounces

A 52-year-old Bloomington woman was arrested Feb. 29 on a warrant for theft after her rent checks for a Solsberry residence bounced and she failed to make the debt right. 

A warrant was issued for the arrest of Marcia Lynn Tucker on Feb. 23 for theft where the value of the property is between $750 and $50,000. 

According to a probable cause affidavit written by Greene County Sheriff’s Department Deputy Devan Goad, he was contacted by Tucker’s landlord who wanted to make a report of fraud. He reported he was contacted by someone claiming to be a former landlord of Tucker’s who reported Tucker was a great renter. The caller alleged she would rent to Tucker again because she was always on time with the rent payment. 

The landlord stated that while he was out of state before Christmas 2023, he received a call from a previous landlord of Tucker’s. The previous landlord questioned whether or not he had attempted to cash the rent check. According to the probable cause affidavit, on Dec. 27, 2023, the landlord showed Deputy Goad a letter from a credit union informing him that Tucker’s check dated Dec. 22, 2023 for the amount of $4,296.77 did not clear. When the landlord spoke with Tucker, she alleged it was a big misunderstanding and he would have the money the following day. The landlord did not receive the money the following day and Tucker would not answer the door or phone. He decided to file an eviction hearing to have Tucker removed from his rental property. 

The landlord contacted two other previous landlords of Tucker’s and all, according to the probable cause affidavit, had experienced the same – receiving checks that were returned for insufficient funds. 

Deputy Goad received bank records which showed that at the time Tucker wrote the check for $4,296.77, she only had $258.51 in her account. Also, according to the probable cause affidavit, records showed that she never had a balance sufficient to cover rent and the account was frequently overdrawn. 

Tucker was arrested Feb. 29 with her bond set at $4,000 surety with 10% cash allowed. She was released the same day after posting $400.
